When is EMP201 due if the seventh is a weekend or public holiday?

When is EMP201 payment due if the seventh falls on a weekend or public holiday?

Direct answer

SARS says employers must submit EMP201 and make payment, if applicable, within seven days after month-end. Where the seventh falls on a weekend or public holiday, SARS says both the EMP201 and payment must be submitted by the last business day before that weekend or public holiday. Do not assume the deadline moves forward to the next business day.

Plan the declaration, authorisation and bank payment before the prior business day. The declaration needs to be submitted before payment, so leaving both steps for late afternoon can create avoidable risk.

What this means in practice

The special rule affects more than a diary entry. A payroll team needs enough time to close payroll, review variances, complete the EMP201, submit it, obtain the PRN, obtain internal payment approval and make the bank transaction. If the seventh is a Sunday, a public holiday or follows a public holiday, the operational deadline may be materially earlier than staff expect.

Use the calendar for the actual month and country public holiday. Do not copy a date from a previous period or assume an internal company closure changes the SARS due date. A sensible control is to set a preparer deadline one or two business days before the SARS deadline, with a reviewer checking the month, account and payment reference.

SARS says a payment cannot be made without first submitting the EMP201. The submitted declaration produces the reference needed to link the payment to the declared allocation. Therefore, a bank payment scheduled early without an accepted EMP201 can cause its own allocation or compliance problem.

Step-by-step

  1. Identify the payroll month-end and calculate the seventh day after it.
  1. Check whether that date is a Saturday, Sunday or South African public holiday. Confirm the calendar rather than relying on a recurring payment template.
  1. If it is not a weekend or public holiday, plan to submit and pay by the seventh. If it is one, set the deadline as the last business day before it.
  1. Close payroll early enough to reconcile PAYE, UIF, SDL and any ETI data before the internal review.
  1. Submit the EMP201 through eFiling or e@syFile Employer. Confirm the period and save the receipt.
  1. Use the PRN generated for that period when making payment. Verify the bank value date, payer account and reference.
  1. Store the receipt and banking proof together. Review the SARS employer account afterwards for unexpected outstanding amounts or allocation issues.

Documents and records to keep

  • Payroll close checklist and calendar check.
  • Reconciled payroll report and EMP201.
  • SARS receipt, PRN and payment confirmation.
  • Any authorisation record or explanation for a correction.

Record the actual action time as well as the intended due date. This is useful if a bank cut-off, access problem or outage needs later investigation. It is not, however, a substitute for a current SARS process where a declaration or payment was late.

Important limits and exceptions

The SARS guidance refers to the EMP201 and payment, if applicable. It does not mean a payment is needed when the final submitted EMP201 shows no amount payable. It also does not decide a payroll calculation, a remission request or a formal debt arrangement.

Do not reuse a PRN from a different period or make a speculative payment because the due date is near. SARS says the PRN links payment with the allocation declared on the EMP201. If data is incomplete, preserve the records and obtain prompt payroll or tax help.

When to get tailored advice

Get tailored advice if the payroll is not reconciled, an EMP201 is outstanding, the employer account has penalties or interest, a SARS audit or revision applies, or a material payment cannot be made on time. Check any demand or SARS correspondence immediately.

TaxProof can help set up a calendar and evidence checklist. It cannot alter a statutory deadline or decide SARS account treatment.
