Do you need to submit a tax return in South Africa?

The single most common tax question we hear, followed by three close relatives: when is the deadline, what is provisional tax, and what happens if I filed late? Here are the straight answers.

Last reviewed:

1. Who must submit an ITR12?

You are required to submit an individual income tax return (ITR12) if any of the following apply to you for the year of assessment:

If your only income was a salary from one employer for the full year, below the annual threshold, with no additional income or deductions, you may not need to file at all. Many taxpayers who should not be filing keep receiving filing demands because their status was never corrected with SARS. That is fixable, but only deliberately.

2. When are the deadlines?

SARS announces exact opening and closing dates each year, and they shift slightly. As a rule of thumb:

Treat published deadlines as fixed. Every year we see penalties that exist purely because someone assumed last year's dates applied.

3. What is provisional tax, and do I owe it?

If you earn income on which no employer deducts PAYE (rental properties, investment returns, freelance or business income), you are likely a provisional taxpayer. Provisional tax spreads your liability across the year through two declarations:

Provisional tax is where self-employed people get hurt most often: no one reminds them, the second-period estimate is guessed, and the underestimation penalty arrives long after the fact. Planned properly, it never surprises you.

4. What happens if I submitted late, or never submitted?

Consequences stack quietly:

The remedy is always the same sequence: file what is outstanding, verify the numbers behind it, then request remission of penalties where reasonable grounds exist. Penalty remission requests succeed or fail on how well the grounds are documented.
