What documents does SARS need for tax-residency cessation?

Direct answer
SARS says every cessation-of-tax-residency declaration needs a signed declaration stating the qualifying basis, a detailed letter of motivation, and a copy of the passport or travel diary showing relevant entry and exit dates. It then asks for additional documents according to the route by which you say residence ceased. The file should explain the facts, not merely collect documents.
For a person who ceased to be ordinarily resident, SARS lists evidence about the foreign visa, permanent residence, foreign tax residence where available, South African property and business interests, family, social interests and return visits. For cessation under the physical-presence test, SARS says only the standard requirements must be supplied. For a double tax agreement route, SARS lists a foreign tax-residency certificate or foreign-authority letter.
What this means in practice
The question is not "what is the shortest document list?". SARS will assess whether the facts support the stated cessation basis. A foreign lease, for example, can be relevant but does not on its own explain why South Africa stopped being your real home. Conversely, a foreign tax-residency certificate may be central for a treaty route but does not replace your own chronology of departure and return trips.
Prepare the document package as a narrative. The motivation should identify the prior residence basis, exact proposed cessation date, country of new residence, reason for the move, family and home arrangements, employment or business links, travel history and current South African connections. Make a contents page that links each factual statement to an attachment. This makes the file easier to review and makes later return preparation more reliable.
Do not confuse a SARS cessation declaration with a retirement-fund directive, an international-transfer request or formal immigration. Each process can ask for different evidence. The same passport and foreign tax records may be useful across processes, but the legal purpose and timing must still be checked separately.
Step-by-step
- Confirm the cessation basis.
Decide whether the facts concern ordinary residence, the physical-presence test or a double tax agreement. Do not create a document list before deciding this.
- Prepare the standard documents.
Sign the SARS declaration, write a detailed motivation and assemble passport pages and a travel diary covering relevant movements.
- Add ordinary-residence evidence where applicable.
Gather the foreign visa, proof of permanent residence if relevant, foreign tax-residency certificate if available, and a clear account of homes, family, work, business, belongings, social ties and visits.
- Add treaty evidence where applicable.
Obtain the certificate or letter from the foreign revenue authority. Keep the applicable treaty and a separate technical analysis for adviser review.
- Create a readable index.
Number documents and cross-reference the motivation. Mask unrelated personal information only where it does not make the evidence incomplete.
- Submit and preserve the case trail.
Upload through the channel SARS directs after the RAV01 declaration or response request. Save the submission receipt, case letter and every follow-up.
Documents and records to keep
- Signed SARS declaration and detailed motivation.
- Full relevant passport copy, travel diary and travel evidence.
- Visa, foreign residence permit and foreign tax-residency certificate where relevant.
- Property, employment, business, family and social-connection records.
- RAV01 confirmation, SARS case correspondence and the document index.
Important limits and exceptions
SARS says a declaration can be declined if the criteria are not met or the taxpayer cannot provide the relevant material. Its list is fact-specific, so this article is a preparation framework rather than a guarantee that the same attachments will satisfy every case. A physical-presence claim requires accurate days and uninterrupted time outside the Republic, while ordinary-residence claims require evidence of the overall factual change.
The file may also expose CGT, foreign-income, treaty and South African-source income issues. Do not use a cessation evidence pack as a substitute for the required asset and tax analysis.
Do not send unrelated records merely to create volume. A concise indexed package with legible copies, dates and a direct connection to the stated basis is more useful than unexplained attachments. If a document is not in English, keep the original and arrange a reliable explanation or translation where its meaning is material.
When to get tailored advice
Ask for specialist help when your family remains in South Africa, you retain property or a business, you are working in several countries, you have a treaty-residence question, or there is a material CGT exit calculation. TaxProof can organise and index the evidence for professional review.
