How do I notify SARS that I have ceased South African tax residency?
How do I notify SARS that I have ceased South African tax residency?

Direct answer
If you have actually ceased to be a South African tax resident, SARS says you should inform it through the Registration, Amendments and Verification Form, known as RAV01, on eFiling. Enter the cessation date in the Income Tax Liability Details section. SARS says a case is then created and it will issue a letter requesting supporting documents. SARS also describes capturing the cessation date on an ITR12 as another channel, which can likewise lead to a document request.
This is a declaration of a tax fact, not an election to stop paying South African tax. Establish the legal basis and date before making the entry, because the declared date can affect the basis on which your returns are assessed and can carry CGT consequences.
What this means in practice
SARS distinguishes several ways in which tax residence can cease. A person who was ordinarily resident must support a factual change showing that South Africa is no longer their real home. A person resident under the physical-presence test can cease after being outside the Republic for a continuous period of at least 330 full days, with the cessation deemed from the day of departure. Residence can also cease through the application of a double tax agreement. The right route depends on how you were resident, not on which documents are easiest to obtain.
Before updating RAV01, prepare a written chronology. It should cover departure, homes, visas, family, work, foreign tax position, travel and South African assets or connections. Keep the date as an evidence-backed conclusion, not a convenient date near year end. SARS specifically says it needs a signed declaration, detailed motivation and passport or travel-diary evidence for all cessation declarations, with further documentation depending on the qualifying basis.
The declaration also needs to be separated from international-transfer or retirement-fund processes. They may require their own applications, evidence and tests. Telling SARS that tax residence ceased does not, by itself, complete a foreign-transfer request or establish eligibility for a retirement withdrawal.
Step-by-step
- Establish how residence ceased.
Determine whether the analysis is ordinary residence, physical presence or a treaty. Record the legal basis and effective date.
- Prepare supporting evidence first.
Assemble the signed declaration, motivation, passport and travel diary. Add documents relevant to your basis, such as a foreign tax-residency certificate, visa, residence evidence and details of South African ties.
- Update RAV01 on eFiling.
Use the Income Tax Liability Details section and enter the supported cessation date. Save a PDF or screen record of the submission.
- Monitor the SARS case.
SARS says it creates a case and issues a supporting-document letter. Read the request carefully and respond through the channel and deadline stated.
- Review tax consequences separately.
Consider the potential deemed disposal of worldwide assets, excluding South African immovable property, and identify assets requiring a CGT calculation.
- Keep filing current.
Complete any outstanding returns and preserve SARS correspondence, assessments and proof of submitted evidence.
Documents and records to keep
- Signed declaration, detailed motivation and a dated travel diary.
- Full passport copy and supporting travel evidence.
- Foreign visa, residence permit and tax-residency certificate if available.
- Details of South African property, business, family and social connections.
- RAV01 submission, SARS case letters, uploaded documents and assessments.
Important limits and exceptions
SARS can decline a declaration where the taxpayer does not meet the criteria or cannot supply the relevant material. A cessation declaration does not erase South African-source tax, settle foreign tax, resolve a treaty tie-breaker or determine exchange-control requirements. It may trigger a deemed CGT disposal of worldwide assets other than South African immovable property, so a material asset schedule should not be left to the last step.
Do not use this guide to select a date for a desired tax result. The correct date follows the facts and the applicable route to cessation.
When to get tailored advice
