Non-resident pension or annuity tax-directive process
How should an employer obtain a tax directive for a non-resident's pension or annuity income?

Direct answer
A non-resident who receives South African-source pension or annuity income may seek relief under an applicable double-tax agreement through SARS's RST01 directive process. It is not automatic, and it is not the route for a lump-sum benefit. SARS says the application is made through eFiling, requires a South African tax number and must identify the country of residence so that the relevant treaty can be considered.
The fund administrator should treat this as a controlled member-onboarding and payment process. Confirm the income type, member identity, current country of residence, treaty and directive status before changing withholding. A residence certificate or an old tax directive without current checks is not enough to prove that relief remains available.
What this means in practice
SARS's current pension and annuity relief page lists the documents required for RST01. They include a certificate of residence and an employment-history letter with information about the periods for which the employee contributed and performed services inside and outside South Africa. Some treaties require proof that income has been included in the country of residence; SARS says that proof cannot be older than one year.
From the 2024 year of assessment, SARS says a relief directive for pension or annuity income is valid for three years. That does not remove all annual controls. Retirement fund administrators and long-term insurers must still ensure the taxpayer provides a residence certificate every year and that the member's place of residence has not changed. SARS says a directive becomes invalid from the date the taxpayer changes to another tax jurisdiction.
The directive file should be linked to the fund's payroll, member records and certificate process. A system flag without the actual directive, residence document and effective dates creates a material withholding risk.
Step-by-step
- Confirm the member and income.
Verify the member's identity, South African tax number, pension or annuity income type and the fund record. Do not classify a lump sum as recurring pension or annuity income merely because it is paid by a retirement institution.
- Test the treaty basis.
Obtain the current DTA and confirm the claimed country of residence. Record the relevant treaty article and have specialist advice where the treaty allows tax in both countries or has special conditions.
- Collect current supporting documents.
Obtain the residency certificate, employment-history letter, fund benefit details and any proof SARS requires of foreign income inclusion. Check that documents are complete, legible and current. Log missing information before submitting.
- Apply using the current SARS process.
Access RST01 on eFiling, complete every required schedule and attach the evidence. Keep the submission confirmation, directive number, effective dates and SARS correspondence in the member file.
- Apply directive controls.
Reconcile the directive to payment cycles and tax certificates. Obtain annual residence confirmation, monitor residence changes and stop relying on a directive when its validity ends or the facts change.
- Correct problems carefully.
If employees' tax was withheld incorrectly, do not simply alter historic payroll. SARS describes a separate refund route involving an ITR12 and RST02 where applicable. Escalate corrections with the directive, IRP5 and member evidence.
Documents and records to keep
Keep the tax number, identity evidence, current certificate of residence, employment-history letter, treaty analysis, RST01 submission, directive, payment and payroll records, annual confirmation and all SARS correspondence. Keep a dated control sheet showing issue date, expiry date, country and next annual review.
Important limits and exceptions
This process does not prove that every non-resident is exempt from South African tax. The DTA and domestic law decide the relief. SARS can reject an incomplete request, a request where tax affairs are not in order, or one where South Africa retains a right to withhold. A change in tax residence is material immediately.
The operational request and the tax conclusion are separate. A fund can help collect evidence and apply the directive controls, but it should not tell a member that a certificate of residence alone changes PAYE. Confirm the directive result, effective dates and conditions before changing withholding. Where a payment has several components or is paid after a member changes residence, obtain a documented technical review.
