How do I request a SARS Certificate of Residence?

Direct answer
To request a SARS Certificate of Residence, identify the correct applicant and requested period, complete the required SARS form, check that South African tax returns are up to date and submit through the applicable official SARS channel. SARS uses RC01 for individuals and RC02 for persons other than individuals, including entities and trusts.
The certificate is SARS evidence of South African tax residence for income-tax purposes, generally used with a foreign tax jurisdiction. It does not by itself decide every foreign tax result or guarantee treaty relief. The applicant must be a South African tax resident during the period requested and must meet SARS's application requirements.
What this means in practice
Begin with the reason for the request. A foreign payer, bank or revenue authority may ask for proof of South African residence before applying a treaty rate or another foreign-tax process. Obtain the foreign request, identify the income or service period and confirm whether it asks for a SARS Certificate of Residence or for SARS to stamp an overseas tax-relief form.
SARS's guide says a certificate is supplied to South African tax residents to prove residence for income-tax purposes to foreign tax jurisdictions that have a double taxation agreement with South Africa. Residence is a factual tax question. For individuals, SARS refers to the ordinarily resident and physical presence tests. A company, trust or other entity should also make sure the application identifies the actual applicant rather than the director, trustee or person preparing the form.
Before submitting, check compliance. SARS says the applicant must be a South African tax resident during the requested period and have up-to-date South African tax-return submissions. If there is an outstanding return, incorrect tax registration or missing information, deal with that issue before treating the certificate request as ready.
Step-by-step
- Identify the applicant, requested residence period, foreign country and reason for the request. Keep any foreign payer or tax-authority request with the application file.
- Confirm which form applies. SARS says individuals use RC01, while entities and trusts use RC02. The person signing for a company or trust does not turn the entity into an individual applicant.
- Complete the form in full. Use the correct South African income-tax reference and verified contact details. Check the requested dates carefully, particularly where the foreign requirement refers to a calendar year and South African records use a tax year.
- Check that all required South African returns are up to date. Resolve registration or filing gaps before submitting. Retain a note of the compliance review, but do not include unnecessary personal information in the application file.
- If a foreign authority requires its own residence or tax-relief form to be stamped, complete the RC01 or RC02 as well. SARS says the local application form must accompany the overseas tax-relief form.
- Submit through the current SARS route. SARS's guide lists a SARS branch by appointment and specified email channels, including category-specific channels for some applicant types. Confirm the current route and address in the live guide immediately before sending.
- Save the submitted form, attachments, proof of submission and SARS response. Review the certificate dates and applicant name before sending it to the foreign requester.
Documents and records to keep
- Completed RC01 or RC02 and the applicant's income-tax reference.
- Foreign request or overseas tax-relief form, if relevant.
- Evidence supporting the claimed residence period.
- Return-filing and registration status checks.
- Submission confirmation, SARS correspondence and issued certificate.
Important limits and exceptions
SARS can reject a request where the applicant is not registered for income tax, the form is incomplete, required returns are outstanding, requested additional information is missing or the applicant does not meet the South African residence tests. Do not send the same incomplete application repeatedly. Read the reason and correct the underlying issue.
The certificate is not a substitute for analysing the double taxation agreement, foreign withholding tax rules or the South African residence tests. It may be requested for a specific period, transaction or foreign jurisdiction. Make sure the application matches the actual request.
When to get tailored advice
Get tailored advice where tax residence is uncertain, the applicant has left South Africa or has dual residence, a trust or company is involved, a foreign authority has a special form, there are outstanding returns or the requested period crosses a change in facts. Advice is also sensible before relying on a certificate for a material foreign-tax claim.
