Can SARS set off my VAT refund against other tax debt?

Last reviewed:

Direct answer

Yes. SARS says that if a VAT vendor has outstanding tax debt, SARS will set the VAT refund off against that debt. Any balance remaining after the set-off is payable to the vendor. A refund shown on a VAT201 is therefore not necessarily an amount that will be paid out in full.

Set-off is only one possible reason for a missing payment. SARS may also withhold a VAT refund where the return is incomplete or defective, bank details are missing, VAT returns are outstanding, or verification, inspection, or audit has not been finalised.

What this means in practice

Start by separating three questions. First, is the VAT refund claim valid? Second, is SARS holding the refund for a verification, banking, return, or other refund-process reason? Third, does the SARS statement of account show debt that could absorb the refund?

These questions can exist at the same time. For example, a vendor may have a valid refund, but SARS may still be verifying it. Or SARS may approve a refund, then apply it against debt on another tax account. The amount that management expected as cash can therefore differ from the refund amount in the VAT201 calculation.

Do not assume that a set-off proves the debt is correct or that a refund claim is correct. The relevant VAT assessment, debt assessment, SARS statement of account, and correspondence need to be read separately.

Step-by-step

  1. Check the VAT201 outcome.

Review the assessment for the relevant VAT period, the refund amount, and the eFiling Refund Dashboard status. Keep the calculation supporting the refund.

  1. Review SARS correspondence.

Look for verification, inspection, audit, bank-detail, incomplete-return, or outstanding-return notices. These can explain a pending refund even where no debt exists.

  1. Review the statement of account.

Identify any unpaid debt, the relevant tax product, and the amount. Compare the debt amount with the expected VAT refund, but do not assume a simple calculation answers a disputed matter.

  1. Match the apparent set-off.

Where SARS has used the refund against debt, retain the statement and correspondence showing the movement. Record the remaining balance, if any, rather than treating the full VAT201 credit as available cash.

  1. Address each underlying issue through the correct process.

A VAT verification needs VAT evidence. A disputed tax debt needs its own review route. A payment-arrangement question is separate from whether a VAT refund has been set off.

  1. Keep records together.

Maintain the VAT201, refund calculations, statement of account, correspondence, and records of payments or set-offs in one file.

Documents and records to keep

  • VAT201, assessment, refund calculation, and eFiling Refund Dashboard status.
  • SARS statement of account and tax-debt correspondence.
  • Tax invoices, customs bills of entry, and VAT reconciliations supporting the refund.
  • Verification or audit requests and proof of documents submitted.

Important limits and exceptions

SARS's refund-set-off statement does not decide whether the vendor's VAT input claims are allowable. It also does not decide whether the debt is disputed, paid, or correctly allocated. Avoid treating the set-off as a substitute for checking the underlying assessments.

This article does not explain the full SARS debt-collection process or payment arrangements. It focuses on the narrow question of what can happen to a VAT refund where outstanding debt exists.

The refund process itself has withholding and suspension rules. If the refund has not yet been authorised, it may be premature to describe the position as a set-off.

When to get tailored advice

Get advice where the VAT refund is material, debt is disputed, SARS has begun verification or audit action, or the statement of account does not clearly explain the balance. Seek help promptly if a business relies on the refund for payroll, suppliers, or other urgent commitments.

TaxProof can help organise the VAT201, statement of account, and correspondence for review. It cannot decide the validity of a disputed debt or direct SARS to release a refund.
