How do I declare DTA deemed-resident amounts on my ITR12?
How do I declare amounts accrued as an exclusive deemed resident of another country under a DTA on my ITR12?

Direct answer
For the 2026 filing season, SARS requires amounts accrued to a taxpayer as an exclusive deemed resident of another country under a double taxation agreement to be declared at transaction level, separately for each institution.
This field is for a treaty-based residence position, not simply for anyone living abroad or holding a foreign account. The applicable DTA must treat the person as exclusively resident in the other country after applying its residence tie-breaker rules.
What this means in practice
Domestic tax residence and treaty residence are related but different questions. A person may meet South African domestic residence rules yet be treated as exclusively resident in the treaty partner country for purposes covered by the DTA. That conclusion depends on the facts and the wording of the relevant treaty.
The return entry should be supported by a residence analysis, dates and institution records. If the taxpayer ceased South African residence, reinstated residence or became resident during the year, ensure that SARS's registered residence indicators are correct because SARS uses them to determine which ITR12 return type is displayed.
Do not use the DTA field as a general exclusion for foreign income. The treaty may allocate taxing rights differently for interest, employment income, pensions, property income or business profits.
Step-by-step
- Confirm the countries in which domestic residence tests may be met.
- Identify the DTA in force between South Africa and the other country.
- Apply the residence article and tie-breaker rules to the taxpayer's actual facts.
- Record the date range for which exclusive treaty residence applies.
- Obtain certificates and statements for each relevant institution and transaction.
- Separate DTA amounts from ordinary local interest, foreign income and exempt interest.
- Capture each institution separately in the applicable ITR12 field.
- Check that the residence status and dates on the return agree with SARS records.
- Retain the technical analysis and evidence in case SARS requests verification.
Documents and records to keep
- Copy of the applicable DTA and relevant residence article.
- Foreign certificate of tax residence, where available.
- South African and foreign address, home and family evidence relevant to the tie-breaker.
- Travel records and residence dates.
- Institution statements and tax certificates.
- Calculation reconciling each transaction to the ITR12.
- Prior SARS residence correspondence or certificates.
Important limits and exceptions
A foreign passport, work visa or foreign tax number does not by itself establish exclusive treaty residence. Likewise, spending time outside South Africa does not automatically end South African residence.
Treaties differ, and later instruments may affect how provisions operate. The treatment of a particular income item must be checked under the relevant article, not inferred from residence alone.
Tax residence changes can also trigger capital-gains consequences and additional disclosure. A return entry should not be used as a substitute for completing the broader cessation or reinstatement process correctly.
When to get tailored advice
Obtain cross-border advice if both countries claim residence, the taxpayer has homes or family ties in both countries, there was a mid-year move, a permanent establishment is involved, or the amounts are material.
