Is an inheritance taxable in South Africa?

Is an inheritance taxable in South Africa, and when might estate duty be payable?

Last reviewed:

Direct answer

South Africa does not generally tax a beneficiary merely for receiving an inheritance. Estate duty is instead calculated in the deceased estate and is normally administered by the executor. The estate's property, deemed property, allowable deductions and applicable abatement determine whether duty is payable.

An inheritance can still lead to other tax consequences. Income earned by the estate before distribution, income earned by the beneficiary after receipt, and a later disposal of inherited assets must be considered separately.

What this means in practice

Do not declare the capital inheritance as salary or ordinary investment income simply because money entered your bank account. Keep the executor's distribution statement showing what was inherited and when.

Estate duty generally covers worldwide property and deemed property of a person ordinarily resident in South Africa. For a non-resident, the South African property rules are narrower. Life policies, retirement benefits, spouse deductions and offshore assets can complicate the calculation.

Step-by-step

  1. Obtain the letters of executorship and liquidation and distribution account.
  2. Separate estate capital from income distributed by the estate.
  3. Confirm whether the executor has filed the estate-duty return and paid any assessment.
  4. Record the tax base cost of each inherited asset.
  5. Declare later income or disposals in the beneficiary's own return.
  6. Retain the estate records for future SARS questions.

Documents and records to keep

  • Will, letters of executorship and distribution account.
  • Estate-duty calculation and assessment.
  • Valuations and asset-transfer documents.
  • Executor's income-distribution certificates.
  • Proof of cash and asset distributions.

Important limits and exceptions

A beneficiary can bear estate duty attributable to certain policy proceeds paid directly to that beneficiary. Foreign estate or inheritance taxes and double-tax arrangements need case-specific review. Donations made before death can also affect the estate-duty calculation.
