Can an independent contractor treat IRP5 income as business income?

Can an independent contractor treat IRP5 income as business income?

Last reviewed:

Direct answer

Possibly, but it is not an election. An independent-contractor label or an IRP5 does not automatically decide that all income is business income. The current SARS ITR12 guide identifies particular commission, independent-contractor and labour-broker source codes and conditions for the trade-income field. The contract, actual working arrangement and certificate must be reviewed before an amount is entered.

SARS Interpretation Note 17 also explains that employee-tax treatment and independent-contractor status involve statutory and common-law considerations. This means a taxpayer should not simply move an IRP5 amount to the trade field to create deductions or leave it as salary because withholding occurred.

What this means in practice

Obtain every IRP5 and read the source codes and amounts, not just the description printed by a client. The ITR12 guide lists codes including 3606 and 3656 for commission income, 3616 and 3666 for independent contractors, and particular labour-broker codes. It says the trading-income field is available where listed-code amounts contribute 50% or more of total IRP5 income, subject to the return's rules, and the amount entered cannot exceed the specified-code total.

That is a return-completion rule, not a blank cheque. If an IRP5 combines commission and other remuneration, the field can be greyed out or locked according to the guide. A contractor should therefore keep the IRP5, contract, invoices, time records, client correspondence, proof of expenses and any exemption documentation. These records help explain both the source-code pattern and the actual trade activity.

Do not rely only on the word "contractor." Consider control and supervision, where work was performed, whether the worker used their own equipment, whether they worked for several clients, who carried commercial risk and what the agreement says. Those facts can be material to tax treatment and employees' tax, but this article does not make that classification for a reader.

Once the appropriate current ITR12 section is available, complete it from reconciled records. Separate income reported on certificates from additional business income not covered by a certificate. Reconcile turnover to invoices and bank receipts. A business expense schedule should identify the purpose, period, invoice and any private element. Keep the full calculation with the return.

Step-by-step

  1. Collect all IRP5 certificates.

Record each source code and amount. Do not combine codes before checking the current guide.

  1. Read the contract and facts.

Keep the engagement agreement, invoices, client instructions, time records and any exemption evidence.

  1. Apply the current ITR12 questions.

Check whether the trade-income field is available and what amount it permits. Do not override a locked field.

  1. Reconcile income and expenses.

Match certificate income to the ledger, invoices and bank records. Allocate any mixed private costs reasonably.

  1. Preserve the support file.

Keep source-code workings, contracts, schedules and all return documents for the record period.

  1. Get advice for mixed facts.

Seek a professional review if the client controls the work, there is one main client, codes conflict or the amounts are material.

Documents and records to keep

  • Every IRP5/IT3(a), contract and client letter.
  • Invoices, timesheets, work records and bank reconciliation.
  • Expense invoices, allocation workings and asset records.
  • Relevant labour-broker exemption documents.
  • Submitted ITR12, assessment and written advice.

Important limits and exceptions

This article does not determine whether a person is an independent contractor, labour broker or employee, and it does not calculate deductions. An IRP5 code, payment method or client label is important evidence but not a complete legal conclusion. Never change a certificate value or source code in the return without a proper basis.

If a client issued an incorrect IRP5, seek a corrected certificate or written clarification. Do not conceal the mismatch by using an unrelated trade description.
