Can a foreign tax credit survive a foreign tax refund?
Can I claim a foreign tax credit after the foreign country refunds the tax?

Direct answer
Do not assume that a foreign tax credit claimed on an earlier ITR12 remains unchanged after the foreign country refunds tax. Preserve the refund notice and updated foreign assessment, reconcile the refund to the income and tax previously reported in South Africa, and obtain advice on the appropriate SARS correction. The correct result depends on the particular credit, the amount ultimately borne, the relevant assessment and the applicable tax rules.
SARS requires taxpayers to keep supporting documents for return entries. A foreign refund is a new source document, not an administrative detail to ignore because the South African return was already submitted. It may explain why a foreign withholding amount changed, why the original foreign assessment was revised, or why the final foreign tax was different from an amount initially claimed.
What this means in practice
First identify exactly what was refunded. A foreign tax authority may refund a portion of withholding, a payment on account, an overpayment on an assessment, interest, a penalty or a currency adjustment. The notice should identify the taxpayer, tax type, income period, original assessment reference, refund amount and date. If it does not, request an explanation from the foreign authority, payer or adviser.
Next link it to the South African file. Locate the submitted ITR12, SARS assessment, foreign-income schedule, original foreign certificates and exchange-rate calculation. Note the line that carried the relevant income and the foreign tax amount. Do not assume that the whole refund relates to one income item if a foreign return covers several income categories or years.
Keep the foreign tax process visible. The original amount may have been withheld by a payer, later claimed back by the taxpayer and partially refunded after a foreign assessment. In that sequence, a payslip proves withholding at one point in time but may not show the final amount. File both documents, rather than replacing one with the other.
Do not make a correction based on a rough estimate. A foreign-currency refund needs a recorded conversion approach, and a foreign notice can contain several components. Where tax, interest and penalty are combined, separate them before considering any effect on the earlier credit. Ask for a corrected tax certificate if one is available.
Step-by-step
- Save the refund evidence.
Keep the notice, updated assessment, bank confirmation and related correspondence. Record when you received each item.
- Identify the original claim.
Retrieve the ITR12, assessment and workpapers that recorded the foreign income and foreign tax credit.
- Reconcile line by line.
Match the foreign tax year, income item, tax type, currency and refund amount. Explain any unmatched balance.
- Separate tax from other amounts.
Identify refunded income tax separately from interest, penalties, administrative fees or exchange differences.
- Obtain a correction view.
Ask a tax professional to review whether and how the South African assessment should be addressed. Do not rely on an assumption based only on the word "refund".
- Retain the final trail.
File the advice, correspondence and any SARS submission with the original claim records.
Documents and records to keep
- Original foreign withholding certificates, returns and assessments.
- Refund notice, revised assessment, payment and bank evidence.
- Submitted ITR12, ITA34 and foreign-income schedule.
- Exchange-rate calculations for the original claim and the later event.
- Written advice and correspondence with SARS or the foreign authority.
Important limits and exceptions
This guide does not say that every foreign refund removes a SARS credit, creates taxable income, or requires the same correction route. Those questions can depend on the applicable provision, the amount ultimately paid, the timing, an assessment status and the facts. A taxpayer with a disputed foreign assessment should not decide the South African result before the dispute position is clear.
Do not delete old evidence. The original withholding record and the later refund notice can both be necessary to explain the sequence. A transparent reconciliation is safer than filing a new number without identifying why the original figure changed.
When to get tailored advice
Seek cross-border advice when a refund is material, spans more than one year, follows a treaty claim, affects a capital gain, or has already produced a SARS assessment. TaxProof can prepare the document chronology for review.
