Is an employer meal or canteen benefit taxable?

Is an employer meal or canteen benefit taxable?

Last reviewed:

Direct answer

It depends on the meal arrangement. SARS treats a meal, refreshment or meal voucher provided free or below value as a taxable fringe benefit, normally valued at the employer's cost less any amount you pay. However, SARS says no value is placed on certain workplace meals, including qualifying canteen, cafeteria or dining-room meals, meals supplied during business or extended working hours, and meals on special occasions.

The label "staff lunch" is not enough to decide the treatment. The place, purpose, timing, policy and employee contribution need to be clear.

What this means in practice

An employer can provide food in several ways: a subsidised canteen, food delivered to the office, a restaurant voucher, a meal at a client event or a cash amount intended for meals. These are not necessarily the same for payroll purposes. Start by checking what you actually received and who paid the supplier.

SARS's no-value rule is specific. A canteen, cafeteria or dining room operated by or for the employer and used wholly or mainly by employees is included. SARS also lists meals supplied during business hours, extended working hours and special occasions. A meal supplied while you are entertaining someone on the employer's behalf is also included in the no-value cases. Board and meals provided with accommodation are dealt with under the accommodation benefit instead.

If the arrangement does not fit a no-value case, ask payroll how it valued the benefit. The general source rule is the employer's cost less any consideration paid by the employee. Do not enter a different value on an ITR12 merely because you think the meal was work-related. The employer must correct inaccurate certificate data it submitted to SARS.

Step-by-step

  1. Identify the arrangement.

Keep the meal policy, invitation, voucher, catering record or canteen terms. Record whether the meal was in the workplace, at a restaurant or paid as an amount through payroll.

  1. Record your contribution.

Retain payslips, receipts and deductions showing anything you paid. Employee consideration affects the value of a taxable meal benefit.

  1. Check the relevant no-value category.

Ask whether the food was a qualifying workplace canteen meal, supplied during business or extended hours, on a special occasion, or while you entertained for the employer. Do not rely on a general verbal explanation.

  1. Ask payroll for its treatment.

Request a written explanation where a benefit appears on a payslip or IRP5. Ask for the policy and the value calculation if the meal was treated as taxable.

  1. Compare your IRP5 or IT3(a).

Check the certificate against payroll records before submitting your ITR12. Raise a discrepancy with the employer rather than changing a prepopulated certificate entry yourself.

  1. Keep the filing record.

Retain the documents, ITR12 and assessment with the payroll correspondence. They provide the evidence trail if SARS later asks about the benefit.

Documents and records to keep

  • Employer food, canteen or hospitality policy.
  • Voucher, invitation, receipt or payroll record.
  • Record of employee contribution.
  • Payslips and IRP5 or IT3(a).
  • Payroll explanation and correction correspondence.
  • ITR12 and ITA34 assessment.

Important limits and exceptions

This article does not calculate the tax on a particular meal. It explains the current SARS categories. A cash meal allowance, travel subsistence amount or accommodation meal can follow other rules and should not be treated as a canteen meal automatically.

The no-value cases are factual. A restaurant voucher that is freely usable, or a recurring private food benefit, may not fit the stated workplace cases. Likewise, an employee contribution can affect the value. Where the arrangement is unusual or forms part of a broader staff-reward package, get a payroll review.

When to get tailored advice

Get tailored advice if an employer provides meal vouchers, food delivery, cash, accommodation board and client entertainment together, or if your IRP5 has a value that payroll cannot explain.

TaxProof can help organise the policy, payslip and certificate records for a focused query to payroll. The employer corrects source data and SARS determines the final assessment.
