Learnership allowance for employers

Can a business claim a deduction for a learnership agreement?

Last reviewed:

Direct answer

An employer should check the current section 12H requirements before claiming a tax allowance for a learnership. SARS Interpretation Note 20 explains that section 12H can provide annual and completion deductions for qualifying registered learnership agreements, subject to its statutory conditions and agreement dates. A training programme is not automatically a qualifying learnership.

Treat the possible allowance as a tax claim supported by a controlled evidence file. The human-resources team may hold the agreement, payroll may hold remuneration records and finance may prepare the ITR14, so someone should own the reconciliation across those teams.

What this means in practice

The usual risk is confusing a useful training initiative with a recognised learnership for tax purposes. Another risk is claiming on a participant who left, whose agreement changed, or whose documents cannot be found. Those facts should be identified before the tax computation is signed off.

Create a learnership register for the tax year. Record each learner's identity, agreement reference, employer, training provider, programme, start date, end date, status, relevant registration or recognition evidence, disability information where relevant, payroll identifier and completion evidence. Keep only information needed for the tax and HR purpose, with appropriate privacy controls.

The register should reconcile to the company's payroll and accounts. If an agreement is signed but has not begun, or a learner completed after year end, do not assume the tax timing without checking the current law. Use a period-specific calculation reviewed against the source documents.

Step-by-step

  1. Gather agreements and recognition evidence.

Obtain signed agreements, programme documents, registration records and any correspondence that establishes the relevant status. Verify that the entity claiming is the employer named in the records.

  1. Build the learner register.

Record dates, changes, completion and departures. Add a document link for every entry. Have HR confirm that the register matches personnel records rather than relying on a spreadsheet carried forward from a prior year.

  1. Reconcile with payroll and finance.

Match learners to employee or payment records, identify the financial year and create a calculation schedule. Investigate duplicate names, periods outside the year and missing agreement numbers.

  1. Check current section 12H requirements.

Use SARS Interpretation Note 20, current legislation and specialist review. Confirm the registered-agreement status, applicable timing and other conditions before inserting an amount in the company tax computation. Do not quote a historical allowance amount.

  1. Complete the ITR14 from reviewed records.

Make current disclosures and retain the calculation with the agreements. Record the person who performed and reviewed the reconciliation.

  1. Keep the file updated.

Add completion, termination or amendment evidence promptly. A complete year-end file is easier to support than a later reconstruction.

Documents and records to keep

Keep signed learnership agreements, programme and registration evidence, learner register, payroll reports, start and end records, completion certificates, correspondence, calculation papers, tax-computation reconciliation, ITR14 workpapers and assessment. Restrict access to personal information and retain it only for lawful recordkeeping needs.

Important limits and exceptions

This article does not confirm that a course, internship or internal training plan is a qualifying learnership. The section 12H conditions, relevant year and taxpayer facts must be considered. Payroll compliance and a company tax allowance are related but not identical questions.

Do not use a completion certificate alone as proof of the full claim. Keep the agreement and timeline as well. Ask for advice before treating a change of employer, disability category, programme amendment or incomplete agreement as straightforward.

When to get tailored advice

Get advice where the programme is large, funded by another party, delivered through a group company, has incomplete records or includes changes during the year. Advice is also useful before amending a prior ITR14 to claim an allowance.
