Does donating an asset trigger capital gains tax?
Does donating an asset, such as shares or property, trigger capital gains tax?

Direct answer
Yes, generally. Giving an asset away is a disposal for capital gains tax purposes. If the donation is not an arm's-length sale, the donor is generally treated as having disposed of the asset at market value on the donation date. The capital gain or loss is calculated using that deemed proceeds amount and the donor's base cost.
The donation can also create a separate donations-tax liability. CGT and donations tax are different taxes, so dealing with one does not remove the need to test the other.
What this means in practice
A gift with no cash payment can still create tax. Obtain a defensible market valuation at the transaction date, especially for property, private-company shares or valuable movable assets. The recipient's future base cost may also be affected by the market-value rule.
Transfers between spouses and certain qualifying donations can receive special treatment, but the exact legal relationship and asset matter.
Step-by-step
- Confirm legal ownership and the date ownership passes.
- Establish market value using reliable evidence.
- Reconstruct the donor's base cost and allowable transaction costs.
- Calculate the capital gain or loss using the applicable deemed proceeds rule.
- Test donations-tax exemptions and filing requirements separately.
- Record the transaction in the correct income-tax return and submit any required IT144.
Documents and records to keep
- Donation agreement and proof of transfer.
- Independent valuation or market-price evidence.
- Original purchase documents and improvement costs.
- IT144, payment proof and correspondence with SARS.
- Recipient acknowledgement and asset register updates.
Important limits and exceptions
Connected-person rules can restrict a capital loss. Property transfers can also involve transfer duty, VAT, deeds-office costs and financing consequences. Do not assume a nominal contract price determines the tax value.
When to get tailored advice
Obtain advice before donating property, a business interest, trust assets, offshore assets or an asset with a large unrealised gain.
