How do I declare rental income from a property partnership?

Direct answer

If you hold rental property with another person through a partnership arrangement, prepare complete partnership records before filing. SARS's ITR12 material says a partnership must declare the full partnership financial details in the rental section, then identify whether the taxpayer is in a partnership and state the percentage held. That annual rental workflow is different from the special CGT instruction for a disposal of partnership assets, where SARS says the individual declares only their own portion of proceeds and base cost.

The fact that parties jointly own a property does not by itself settle whether their arrangement is a partnership for tax reporting. The agreement, contributions, profit-sharing, control and actual conduct matter. This article explains evidence-led return preparation, not the legal classification of every co-ownership arrangement.

What this means in practice

Obtain the partnership agreement or a clear written record of the parties' allocation. Then make a partnership-level rental schedule: gross rent, deposits or recoveries, permissible expenses, capital items, property-use dates and the resulting profit or loss. Reconcile it to the partnership bank account and supplier invoices. The current ITR12 rental material directs partners to declare the full partnership financial details and disclose the percentage held, so keep a common schedule capable of supporting those fields.

Keep rental revenue expenses distinct from capital items. SARS's rental guidance says permissible costs may include rates and taxes, bond interest, advertising, agent fees, qualifying homeowner insurance, garden services, repairs to the let area, security and levies, while private and capital costs are not allowable. The partner's claim should follow their entitlement and the facts, not simply the name on a supplier invoice.

SARS's 2025 ITR12 update says that where a taxpayer is in a partnership and partnership assets were disposed of during the year, the taxpayer declares only their own portion of proceeds and base cost on the individual return. That is a disposal point, distinct from annual rental income. Maintain a separate sale and CGT schedule if the partnership property was sold.

Step-by-step

  1. Confirm the arrangement and each person's share.

Keep the agreement, title records, loan documents and a schedule of contributions and profit-sharing.

  1. Produce a complete partnership rental schedule.

Reconcile rent to bank deposits and expenses to invoices before calculating any partner share.

  1. Separate revenue and capital items.

Retain acquisition, improvement and disposal evidence outside the annual rental-expense schedule.

  1. Prepare your individual share statement.

Retain the full partnership financial details, your percentage held and, where applicable, variable income or expense ratios. Make the calculation understandable without oral explanation.

  1. Complete the current ITR12 prompts.

Enter the full partnership rental financial details and percentage held where the current ITR12 requires them. This does not replace the separate CGT treatment for a partnership-asset disposal.

  1. Treat a disposal separately.

If partnership assets were sold, retain your own share of proceeds and base cost for the relevant individual CGT disclosure.

Documents and records to keep

  • Partnership agreement, title and loan documents.
  • Common bank statements, rental ledger and supplier invoices.
  • Full partnership financial statements, percentage-held calculation and correspondence approving any variable ratios.
  • Current ITR12, ITA34 and separate CGT disposal schedule where relevant.

Important limits and exceptions

The ITR12 form workflow does not decide whether an arrangement is legally a partnership or whether an owner is entitled to a particular percentage. Community of property, a trust or company partner, a deceased estate, related-party arrangements and a disputed allocation can need specialist review. A partner should not duplicate a full deduction already claimed by another party.

Do not conflate a property partnership with a body corporate or a company. Each has different records and possible tax consequences.
