How do I declare a foreign employer that did not issue an IRP5?

How do I declare a foreign employer that did not issue an IRP5?

Direct answer

The absence of an IRP5 does not decide whether foreign employment income belongs on your South African return. An IRP5 is a South African employer reporting certificate, while a foreign employer may use a different payroll system or provide no year-end certificate at all. If you are a South African tax resident, first determine whether the remuneration must be included in your ITR12, then use reliable employer and foreign-tax evidence to complete the current foreign-income fields.

SARS's ITR12 guide covers foreign income and foreign tax credits. SARS's foreign employment exemption page also confirms that a qualifying resident employee may obtain a limited exemption only if the employee, foreign-services and day-count requirements are met. No IRP5 is not evidence of exemption, non-residence or no tax liability.

What this means in practice

Start with a payroll reconstruction that someone else can follow. Request an employer letter or annual statement showing the employer's legal name and country, your position, employment dates, gross remuneration, each allowance or benefit, payroll deductions, foreign income tax, social-security amounts, pay dates and the currency used. Add monthly payslips, contract, bank statements and foreign annual tax records. Reconcile the annual total to the amounts received, but do not treat bank deposits as the only evidence where they include expense reimbursements or transfers.

Next, establish where you performed the services. This matters for the foreign employment exemption and the source analysis. Keep a travel diary with passport, itinerary and employer roster support. If you worked partly in South Africa and partly abroad, do not simply describe all remuneration as foreign employment income. Mark the periods and ask a cross-border adviser to review any allocation that is material.

The ITR12 experience changes over time. Use the current SARS guide and current eFiling prompts rather than copying historic field numbers or an old tax return. Prepare the supporting schedule before you open the return, then keep the schedule and attachments after submission in case SARS requests verification.

Step-by-step

  1. Confirm tax residence for the relevant period.

A foreign employer's location does not answer whether you are subject to South African tax on worldwide income.

  1. Obtain an employer annual statement.

Request gross pay, benefits, deductions, foreign income tax, pay period, currency and service location details. Ask for a signed explanation if a formal certificate is unavailable.

  1. Reconcile earnings.

Build a month-by-month table that links the employer statement to payslips and bank deposits. Identify reimbursements, bonuses, shares and non-cash benefits separately.

  1. Record foreign-service days.

If considering the foreign employment exemption, create a rolling 12-month full-day and continuous-period record supported by travel documents.

  1. Identify foreign tax proof.

Obtain a foreign withholding certificate, assessment, tax return and payment record. Separate income tax from social security and other deductions.

  1. Complete the current ITR12.

Use the applicable foreign-income, exemption and foreign-tax-credit fields in the current SARS guide. Save the pre-submission schedule and final assessment.

Documents and records to keep

  • Employment contract, foreign employer letter and annual pay statement.
  • Monthly payslips, bank statements and benefit or share-plan records.
  • Passport, travel diary, tickets and employer rosters.
  • Foreign tax return, assessment, withholding certificate and payment proof.
  • Currency-conversion workings and a copy of the completed ITR12.

Important limits and exceptions

An IRP5 is useful where it exists, but the lack of one does not authorise an estimate, omission or invented certificate. The foreign employment exemption is only for qualifying resident employees with the required foreign-service days and is limited in amount. A foreign tax credit requires a separate analysis of taxable income, qualifying foreign tax, evidence and current limitations.

This article does not determine whether an arrangement is employment or independent contracting, calculate an exemption or foreign tax credit, or resolve a treaty residence issue. A director, consultant, remote worker, share-plan participant or person moving during the tax year may need a more detailed review.
