Do I need to declare a foreign bank account to SARS?

Do I need to declare a foreign bank account to SARS?

Direct answer

A foreign bank account can be relevant to the foreign-asset and foreign-income questions in the current SARS ITR12 process. The answer depends on the return-year questions, the legal owner, the taxpayer's tax residence and what income or gains arose in the account. An offshore account is not automatically taxable merely because it exists, but it should never be omitted simply because the bank is outside South Africa.

Start with an account register. List each bank, country, account type, legal holder, opening and closing dates, ownership share and whether it generated interest or other investment income. Use records, not memory.

What this means in practice

An account balance is different from income. A balance may include money you transferred from South Africa, employment income, interest, dividend proceeds, sale proceeds or foreign currency movements. Do not report the closing balance as interest, and do not treat a transfer of your own capital as income only because it appears on an offshore statement.

Joint accounts require special care. Record the legal holders and your actual beneficial interest. An account held by a trust, company or another person is not automatically your individual bank account, but a connection with an entity may create other disclosure or income questions. Preserve account-opening documents and authority records instead of relying on a nickname in online banking.

Foreign accounts can also produce annual interest, fees and foreign tax withholding. Download the annual statement and interest certificate, if available. Keep gross income and foreign tax separate. A bank fee or foreign social-security deduction is not proof of foreign income tax. Convert relevant income amounts to rand using a documented method and keep the supporting rate records.

Step-by-step

  1. Build an account register.

Include every foreign savings, current, fixed-deposit and broker cash account, even if it was closed during the year.

  1. Confirm ownership.

Retain account-opening documents, mandates and trust or company records where applicable. Record joint ownership accurately.

  1. Separate balance from transactions.

Reconcile opening balance, deposits, withdrawals, interest, charges and closing balance. Explain large transfers.

  1. Obtain annual income evidence.

Save statements showing gross interest, withholding tax, currencies and dates. Download records before moving banks.

  1. Review current ITR12 questions.

Follow the current SARS guide and answer from the register and supporting records. Do not copy answers from an older return.

  1. Keep the disclosure file.

Retain the register, statements, conversion schedule, return, assessment and correspondence.

Documents and records to keep

  • Account-opening records, annual statements and closure confirmation.
  • Interest certificates, broker reports and foreign withholding evidence.
  • Transfer records explaining capital movements.
  • Joint-account, trust or company authority records where relevant.
  • Currency workings, filed ITR12 and SARS correspondence.

Important limits and exceptions

This article does not decide tax residence, foreign-account exchange-control requirements, foreign disclosure obligations or whether a balance is taxable. The current ITR12 wording and the taxpayer's facts control the answer. A person who ceased South African residence, holds a foreign account through a trust or company, or has undeclared historic income needs tailored advice.

Do not guess an account balance or currency conversion. If records are missing, obtain statements from the institution and preserve the request trail.

Review the register before each return, not only when opening or closing an account. An old account with a small balance can still have earned interest or been closed after a transfer. Record the closure date and final statement, and explain where the balance went. If information was prepopulated or supplied by another party, compare it to the account register before accepting the return. Correctly identifying the account owner is more important than trying to match an online bank nickname.

Retain access records securely, but never place passwords, one-time codes or full banking credentials in the tax working papers.

Use a separate protected access method while keeping only non-sensitive account identifiers in the disclosure schedule.
