How does an NPC or trust apply to SARS for PBO income-tax exemption?

Direct answer
First register the organisation for income tax under the correct legal form, appoint its registered representative and make sure the founding document meets the public benefit organisation rules. Then submit the income-tax exemption application and supporting documents through the current SARS tax-exempt institution process.
An NPC registration, an NPO certificate or a charitable purpose does not automatically create income-tax exemption. Approval is granted by SARS under the Income Tax Act and is confirmed in an approval letter with an exemption reference number.
What this means in practice
The founding document is the foundation of the application. It should establish the qualifying public benefit activities, non-profit character, fiduciary controls, use of funds and dissolution treatment required by law. Do not make statements in an application that contradict the trust deed, constitution or memorandum of incorporation.
The eFiling profile must also use the correct Nature of Entity. SARS says this choice is driven by the founding document and controls which exemption application category is available.
Step-by-step
- Identify whether the entity is an NPC, South African trust, association of persons or qualifying foreign branch.
- Register it for income tax and confirm the reference number.
- Appoint and register the representative with SARS.
- Compare the founding document and actual activities to the Section 30 PBO requirements and the listed public benefit activities.
- Correct genuine founding-document defects through the proper legal process before applying.
- Select the correct Nature of Entity and exemption category, then submit the application and requested supporting records.
- Monitor SARS correspondence, answer requests through the case and keep the approval or refusal letter.
Documents and records to keep
- CIPC documents, trust deed and Letters of Authority, or association constitution.
- Resolution appointing the representative and proof of identity.
- Income-tax registration and RAV01 details.
- Activity descriptions, budgets and recent financial records.
- Application, supporting documents and SARS outcome.
Important limits and exceptions
Section 18A approval to issue tax-deductible donation receipts is separate and has narrower qualifying activities. Do not promise donors deductible receipts merely because a PBO application has been filed.
Approval is monitored after it is granted. Changes to activities, governance or founding documents can affect continued qualification.
